Residence cards for EEA Nationals and Family

 

Whilst the current view is that those already here will be able to remain there is clearly no absolute guarantee of this and so an increasing number of EEA Nationals and their families, once they have been here in the UK exercising their Treaty Rights for five years, are applying for Permanent Residence Cards.

As with Indefinite Leave to Remain, a robust bundle of documents needs to be prepared to support these applications, a service which UK Visas provide for clients prior to submitting their applications.

Because the UKVI are taking up to six months to consider these applications, UK Visas ensure that their clients’ passports are returned as soon as the Home Office fees have been taken (usually about a month after the application).


EEA Family Permits


If you are the partner of an EEA National and wish to come to the UK either with them or to join them, you should apply for a six month EEA Family Permit in order to enter the UK.  If you are a non-visa National we would still recommend you apply for an EEA Family Permit so you can work, which you cannot do as a visitor.

This six month permit entitles you to reside and work in the UK as long as your EEA partner is exercising their Treaty Rights eg: studying, working or seeking work.  However, any potential employer may require you to provide proof of your right to work, and in this instance we recommend you apply for an EEA Residence Permit as soon as you enter the UK. 


EEA Residence Permits for non-EEA family members of an EEA National


If you are a non-EEA family member of an EEA National who is exercising their Treaty Rights and wish to be employed you should apply for an EEA Residence Permit before doing so.  Once a Certificate of Application has been received from UKVI confirming your application is under consideration, you may then show this to a prospective employer as your “Right to Work”.

 

Fees breakdown

Our fee for managing EEA Family Permit visa applications is:

Out of Country application, EEA Partner employed (or has an offer)

£650 + VAT

Out of Country application, EEA partner self-employed:

£1295 + VAT

 

 

There are no Home Office charges for considering EEA Family Permit applications

EEA Partner employed/studying

                                                                                  £650 + VAT

EEA partner self-employed:

                                                                                  £1295 + VAT

 

 

The Home Office charges are £65 per applicant
