The Creative Worker (CW) visa currently provides employers with the flexibility to bypass a labour market assessment linked to this visa if the relevant occupation is listed on the Shortage Occupation List.
Following their recent 'Rapid Review' of the Immigration Salary List (formerly referred to as the Shortage Occupation List), the Migration Advisory Committee (MAC) has suggested eliminating this reference to the SOL and abolishing the labour market evaluation. They have also proposed that the Home Office establish a minimum salary threshold for the CW visa to ensure that there is no financial advantage in using this visa to offer lower salaries compared to the Skilled Worker route for the same position. This suggestion is particularly relevant given the increase in Skilled Worker salary thresholds, and the MAC is urging the government to consider the recommendations put forth to safeguard both migrant and resident workers.
