What Is ILR for Skilled Worker Visa Holders?

ILR is the final step in the Skilled Worker route before British citizenship.

Definition of Indefinite Leave to Remain

Indefinite Leave to Remain is a form of permanent residence granted under UK immigration law. It removes time restrictions on your stay and allows you to remain in the UK without extending your visa.

ILR is not the same as permanent residence under EU law, nor is it British citizenship. It remains an immigration status rather than a nationality.

Once granted, ILR allows you to live in the UK indefinitely, provided you do not remain outside the UK for more than two consecutive years.

Minimum Residency Requirement

Meeting these residence criteria is a core part of the ILR requirements for skilled worker applicants:

5-Year Continuous Residence Rule

Most Skilled Worker applicants must complete five years of continuous lawful residence in the UK before applying for ILR.

Time spent under the following may count:

  • Skilled Worker visa
  • Tier 2 (General) visa
  • Certain other eligible work categories

Time spent switching between Tier 2 and Skilled Worker visas can usually be combined, provided there are no gaps in lawful status.

Absence Limits Explained

Applicants must not spend more than 180 days outside the UK in any 12 months during the qualifying five-year period.

Absences are typically calculated on a rolling basis. Accurate travel records are essential.

Passport stamps, travel tickets, employer letters, or explanatory statements, where required, may qualify as evidence.

What Breaks Continuous Residence

Continuous residence may be broken by:

  • Excessive absences exceeding permitted limits
  • Gaps between visa grants
  • Periods of overstaying
  • Switching into non-qualifying visa categories
  • Certain criminal convictions

If you break the continuous residence criteria, your qualifying period will reset.

Salary Requirements for Skilled Worker ILR

Here’s the salary requirement for ILR under the skilled worker route:

Minimum Salary Threshold

Applicants must meet the general minimum salary requirement at the time of application: at least £41,700 per year.

The annual gross salary is calculated before tax for the salary requirement. Part-time roles are assessed on a pro-rated basis, provided the salary still meets the minimum threshold.

Going Rate Requirement

In addition to the general minimum, you must meet the “going rate” for your occupation.

The going rate is based on your Standard Occupational Classification (SOC) code. Your salary must meet or exceed the Home Office published rate for your job role.

Failure to meet the correct occupation-based salary can result in refusal.

Exceptions and Lower Salary Cases

There might be some exceptional cases where a lower salary limit may apply, for example:

  • Shortage occupation roles
  • Certain PhD-level roles
  • Health and care worker concessions
  • Applicants benefiting from transitional arrangements

Employment and Sponsorship Criteria

Sponsorship compliance remains central to approval. The following evidence is required from applicants:

Employer Confirmation Letter

Your employer must provide a letter confirming:

  • You are still required for the role
  • Your job title and duties

The letter must meet Home Office standards.

Valid Certificate of Sponsorship

A valid Certificate of Sponsorship (CoS) must be in place.

Your sponsor must hold a valid sponsor licence and remain compliant with sponsor duties. The SOC code used must accurately reflect your role.

Proof of Job Is Still Required

The Home Office must be satisfied that your role is genuine and still required by the employer.

There must be a genuine vacancy and ongoing need for your position.

English Language and Life in the UK Test

These are mandatory components of the ILR requirements for skilled worker applicants:

Accepted English Language Proof

Applicants may rely on:

  • A UK degree
  • A degree taught in English (with ECCTIS confirmation if required)
  • An approved English language test

This rule doesn’t apply to individuals who come from a majority English-speaking country.

Life in the UK Test Requirement

Applicants must pass the Life in the UK Test.

The test covers British history, culture and laws. It must be booked online and passed before applying for an ILR.

Exempt Applicants

Exemptions from the above two criteria may apply for:

  • Applicants aged 65 or over
  • Those with qualifying medical conditions
  • Applicants who previously met the requirement at the correct level

Documents Required for Skilled Worker ILR

Passport and BRP

You must provide:

  • Current passport
  • Previous passports (if applicable)
  • Expired Biometric Residence Permit
  • Proof of lawful residence

Payslips and Bank Statements

Only require the latest payslip prior to application submission.

Payslips must match bank deposits and may require employer stamps or signed verification.

Employment and Salary Evidence

Supporting evidence may include:

  • Employer confirmation letter
  • Most recent Certificate of Sponsorship
  • HMRC employment history, where requested

When You Can Apply

You can apply up to 28 days before completing your five-year qualifying period.

Accurate calculation of your eligibility date is essential to avoid early refusal.

Online Application Submission

You must complete the SET(O) form online, pay the application fee and upload supporting documents.

Biometrics Appointment

Applicants must attend a UKVCAS appointment to provide fingerprints and a photograph.

Original documents may need to be scanned and uploaded.

You are allowed to change employers, but your new employer must have a valid sponsor licence and reissue a new CoS. You must update your visa before applying for ILR.
