Settlement under the Tier 2 route allows skilled migrant workers who have contributed to the UK economy to remain in the country permanently. Many professionals working in the UK under employer sponsorship aim to obtain ILR after completing several years of lawful employment.

Definition of Indefinite Leave to Remain

Indefinite Leave to Remain is a permanent residency status granted by the UK government. It allows individuals to live, work, and study in the UK without time restrictions on immigration.

Upon approval, ILR holders are no longer bound to a sponsoring employer. They can switch jobs, become self-employed, or pursue other career options without having to seek further visa sponsorship.

Benefits of Getting ILR

There are several long-term benefits to acquiring ILR. Individuals with ILR can work for any employer without sponsorship requirements and are not subject to immigration time limits. They can also access some public funds, provided they are qualified under UK law.

This settlement status enables people to move in and out of the UK without having to renew their visa. Upon satisfying additional residency criteria, ILR holders can also apply for British citizenship and get a UK passport.

Who Can Apply Under the Tier 2 Route

Individuals who previously held a Tier 2 (General) visa or currently hold a Skilled Worker visa may qualify for settlement after completing the required continuous residence period.

Dependants of Tier 2 visa holders, such as partners and children, may also apply for ILR if they meet their own residence and eligibility requirements.

5-Year Continuous Residence Rule

Most applicants must complete five years of continuous lawful residence under qualifying work routes such as the Tier 2 (General) visa or Skilled Worker visa.

Time spent under certain other eligible work visas may also count toward this five-year qualifying period if immigration status has been maintained without interruption.

Applicants must comply with strict absence rules. In most cases, the applicant must not be away from the UK for more than 180 days in any 12 months within the five-year qualifying residence period.

Salary Criteria for Tier 2 ILR

Salary requirement is calculated as gross annual earnings of the person without tax deductions.

According to the 2026 ILR salary requirements for tier 2, applicants must meet the £ 41,700-per-year threshold to apply for ILR.

Going Rate for Occupation

Applicants must also meet the “going rate” for their occupation. The going rate is determined by the job’s Standard Occupational Classification (SOC) code.

The applicant's salary should not be below the minimum salary threshold or the prevailing rate for the particular job (whichever is higher).

Exceptions and Transitional Rules

Some applicants may qualify under transitional salary rules if their visa was granted under earlier Tier 2 immigration policies.

In certain sectors, including healthcare, salary thresholds may differ. Applicants working in shortage occupations or specific public service roles may also benefit from adjusted requirements.

The employment and sponsorship terms for Tier 2 applicants for ILR:

Employer Confirmation Letter

The applicant requires a letter from their employer confirming that they remain employed in their role and that their salary meets the criteria.

The letter should also affirm that the position will be sustained in the foreseeable future.

Certificate of Sponsorship Requirement

Although applicants usually do not need a new Certificate of Sponsorship when applying for settlement, as per ILR requirements for Tier 2, they must still be sponsored by an employer holding a valid sponsor licence.

The Home Office may review sponsorship compliance when assessing the application.

Proof Your Job Is Still Needed

The employer must confirm that the job role is genuine and necessary within the organisation.

The Home Office may examine whether the role meets the required skill level and remains part of the organisation’s workforce structure.

English Language and Knowledge Requirements

Applicants must demonstrate their ability to integrate into UK society through language and knowledge tests.

Accepted English Language Proof

English language proficiency can be demonstrated in several ways. Applicants may pass an approved B1 English language test, hold a recognised degree taught in English, or be a national of a majority English-speaking country.

Life in the UK Test Requirement

Applicants must also pass the Life in the UK Test, which assesses knowledge of British culture, traditions, laws, and history.

The test must be passed before submitting the ILR application.

Who Is Exempt

Some applicants may be exempt from the English language and Life in the UK Test requirements. Exemptions typically apply to individuals over a certain age or those with specific medical conditions that prevent them from meeting the requirement.
