What Is Indefinite Leave to Remain (ILR)?

Before you apply for citizenship, understand what ILR status is and how it differs from nationality.

What Is the ILR Status?

Indefinite Leave to Remain is a type of permanent residence granted through the UK immigration law. With this status, you are allowed to live and work in the UK for as long as you want without having to renew your existing visa.

British nationality, however, is not the same as ILR. It remains an immigration status and may expire after you have been outside the UK for more than 2 years. In such a case, you might be required to apply under the Returning Resident route.

Yes, ILR holders may seek British citizenship through naturalisation, provided they are eligible.

Eligibility Requirements for Naturalisation

To qualify, applicants must fulfil the following criteria:

  • Hold a valid ILR
  • Meet residency and absence requirements
  • Qualify in the Life in the UK Test
  • Meet English language standards
  • Satisfy the Good Character requirement
  • Be aged 18 or over
  • Intend to continue living in the UK

Minimum Waiting Period After ILR

Under the standard route, you must wait 12 months after being granted ILR before applying for citizenship.

However, if you are married to or in a civil partnership with a British citizen, you do not have to wait 12 months, from when you have obtained ILR.

Residency and Absence Rules

Applicants must meet these strict physical presence requirements:

  • 5-year qualifying period (or 3 years if married to a British citizen)
  • No more than 450 days outside the UK in the 5 years or 270 days in the last 3 years (if married to a British Citizen)
  • No more than 90 days outside the UK in the final 12 months

The Home Office may exercise discretion in limited circumstances, but this is never guaranteed.

Applicants must score at least 75% to pass. Preparation is important, as repeated failure delays eligibility.

Paying the Application Fee
