As a sponsor, it is crucial to comply with these duties to maintain your sponsor licence.

Failure to do so can lead to its revocation, which could have significant consequences for your organisation.

To ensure compliance, it is imperative that you -

• promptly report any events related to your organisation or sponsored workers,
• maintain accurate records of sponsored workers and their recruitment processes,
• adhere to both sponsor guidance and UK law.

By fulfilling these obligations, you contribute to the overall integrity of the immigration system and prevent its abuse.

Several instances of non-compliance that were identified by the Home Office during a recent compliance visit include -

• paying employees less than the amount stated on their CoS without notifying the Home Office,
• failing to provide sick pay and recouping the immigration skills charge from sponsored workers.

To avoid such pitfalls, it is essential that you strictly adhere to the guidelines outlined in the sponsor guidance this includes –

• ensuring appropriate salary levels,
• provide sick pay as required, and
• not recouping any costs from sponsored workers.

Additionally, it is important to conduct thorough right-to-work checks before employment commences and maintain accurate records of visa expiry dates for employees who have a time-limited right to work in the UK.

By diligently following these requirements, you not only safeguard your sponsor licence but also actively contribute to the positive functioning of the UK's immigration system.

It is crucial to stay updated with any changes in the law and regularly review your company policies and contracts to ensure they align with the current legal framework.
